These Website Terms of Use (“Terms”) are between you and Creators Agency LLC, a Wyoming limited liability company that operates the Money Matchup platform (“Money Matchup,” “Company,” “we,” “us,” or “our”). They govern your access to and use of moneymatchup.com and each Money Matchup website, subdomain, page, tool, quiz, or public service that links to these Terms (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. If you use a creator account or participate in the Money Matchup creator affiliate program, the Creator Affiliate Program Agreement also applies. The offer or product, final Creator Rate, and Conversion Event displayed and recorded for an Affiliate Link supply the offer-specific details under that Agreement.

1. Eligibility and geographic scope

You must be at least 18 years old and legally able to enter these Terms. Public financial-product content and offers are intended for people in the United States and products available in the United States unless a page expressly states otherwise. A page’s passive availability or organic distribution outside the United States does not mean that a product is offered or available there. The separate Creator Program may accept Creators in supported countries, including the United Kingdom and Canada. Unless Money Matchup expressly identifies another eligible territory, the Creator Affiliate Program Agreement limits deliberate targeting to eligible United States audiences while allowing ordinary incidental organic reach elsewhere. You may not use the Services where doing so would violate law or another binding obligation.

2. What Money Matchup provides

Money Matchup provides general educational, comparison, promotional, and affiliate content concerning financial and other products and services. The exact features and product categories may change.

Unless a page expressly and accurately states otherwise, Money Matchup is not a bank, credit union, card issuer, creditor, lender, loan broker, insurance company or producer, broker-dealer, investment adviser, tax adviser, law firm, credit-repair organization, or fiduciary. Money Matchup does not itself make underwriting, credit, insurance, suitability, account-opening, or approval decisions.

The Services are not individualized financial, investment, legal, accounting, or tax advice. Information on the Services does not create an advisory, fiduciary, agency, or professional-client relationship. You are responsible for evaluating whether a product is appropriate for you and, when appropriate, consulting a qualified professional.

3. Offers, eligibility, and provider decisions

A provider’s current application, disclosures, agreement, and terms govern the product it offers. Rates, annual percentage rates, annual percentage yields, fees, rewards, bonuses, eligibility requirements, availability, insurance status, and other product terms can change. Review the provider’s current disclosures before applying or opening an account.

Money Matchup does not guarantee that information will always be complete, current, or error-free. Date-sensitive information should display an “accurate as of” date or other source where appropriate. If information on Money Matchup differs from current information supplied by a provider, the provider’s current disclosures control.

Money Matchup does not guarantee approval, eligibility, a credit limit, a rate, a reward, a bonus, savings, earnings, investment performance, insurance coverage, product availability, or any other outcome. Providers make their own decisions under their own criteria. Using Money Matchup does not improve or guarantee your eligibility.

Money Matchup does not review or include every financial institution, provider, or product available in the market. An omitted product may be better suited to a particular person than a product shown on the Services.

4. Affiliate compensation and product selection

Money Matchup may receive compensation when you click a tracked link or when an event such as an application, approval, purchase, account opening, or other Conversion Event occurs. The event and amount vary by partner and offer. See the Money Matchup Affiliate Disclosure at https://partners.moneymatchup.com/affiliate-disclosure.

Compensation is paid by participating partners and generally does not create a separate charge to you for using a Money Matchup link. This statement does not mean that every provider offers identical pricing through every channel.

Money Matchup does not currently sell sponsored placements, paid rankings, or higher positions. If that practice changes, Money Matchup will update its disclosures before launch and clearly label any paid placement as “Sponsored,” “Advertisement,” or another term ordinary consumers can understand.

Money Matchup evaluates many offers and presents a limited curated selection rather than the full market. Commercial compensation and the ability to offer competitive Creator Rates influence which offers Money Matchup chooses to make available. Money Matchup does not currently assign formal rankings or scores, use an algorithm to boost an offer because it pays more, or accept payment for higher placement. Inclusion or omission is not a statement that an offer is best or worst for a particular person. The selection methodology is described at https://partners.moneymatchup.com/methodology.

The Affiliate Disclosure and this section are supplemental. They do not replace a clear contextual disclosure on a monetized page, near a link or recommendation, or in creator content.

5. Editorial and advertising standards

Money Matchup seeks to present information that is accurate and useful, but some facts and materials may come from providers, advertisers, affiliate networks, or other third parties. Content may be reviewed for legal, factual, brand, or compliance requirements. Money Matchup will not state that advertisers never review content unless that statement is operationally true.

An opinion, selection, comparison, or recommendation must reflect the disclosed methodology and available support. Money Matchup will not knowingly publish fake reviews, fabricate experiences, condition an incentive on positive sentiment without lawful disclosure, suppress legitimate negative reviews, or alter a review in a misleading way.

Required product disclosures on a page or advertisement are part of the relevant content. Nothing in these Terms reduces or replaces disclosures required by consumer-financial, advertising, securities, insurance, privacy, or other law.

6. Acceptable use

You may use the Services only for lawful, personal, and noncommercial purposes unless Money Matchup gives you written permission for another use.

You may not:

(a) violate law or another person’s rights;

(b) submit false information, impersonate another person, or engage in fraud or deception;

(d) probe, scan, scrape, crawl, index, or use a bot or automated process except as expressly permitted by Money Matchup or by standard search-engine instructions;

(e) bypass access, rate, geographic, security, or technical controls;

(f) interfere with the Services or introduce malware, harmful code, or excessive traffic;

(g) alter, obscure, or misuse a tracking link, disclosure, copyright notice, or trademark;

(h) send spam or unauthorized advertising through the Services;

(i) use the Services to infringe intellectual-property, privacy, publicity, or contractual rights; or

(j) reverse engineer the Services except to the limited extent applicable law prohibits that restriction.

7. Accounts and creator features

Every registered Money Matchup account is a Creator account. You must provide accurate information, keep it current, safeguard your credentials, and promptly report suspected unauthorized access to apple@creatorsagency.co. You are responsible for activity conducted through your account to the extent permitted by law.

Creator accounts, affiliate links, commissions, offer records, and creator content are governed by the Creator Affiliate Program Agreement. Merely visiting the public Services does not enroll a person in the creator program or constitute acceptance of that Agreement.

8. Intellectual property and permitted use

Money Matchup and its licensors own the Services and their text, software, design, graphics, databases, trademarks, and other content, except for material clearly identified as belonging to another person. These Terms give you a limited, revocable, nonexclusive, nontransferable right to use the Services for their intended purpose. They do not transfer ownership or grant a right to reproduce, sell, publicly display, create derivative works from, or commercially exploit the Services.

You may link to a public page in a lawful and nonmisleading manner that does not imply sponsorship or endorsement. Money Matchup may revoke permission if the link is deceptive, unlawful, or harmful.

If you voluntarily provide feedback about the Services, Money Matchup may use it without restriction or compensation, but this does not grant Money Matchup rights in your confidential information, identity, or separately protected content.

To report suspected infringement, contact apple@creatorsagency.co with enough information to identify the work, material, location, and basis for the complaint.

9. Third-party services and links

The Services may link or redirect to providers, advertisers, networks, social platforms, or other third parties. Third parties operate under their own terms and privacy notices. Money Matchup does not control their services, security, availability, underwriting, product decisions, or data practices.

A link may reflect an affiliate or advertising relationship and may also accompany an editorial recommendation. The presence of a link does not make Money Matchup the provider of the linked product.

10. Privacy and electronic communications

The Money Matchup Privacy Notice at https://partners.moneymatchup.com/privacy describes how Money Matchup handles personal information. It is a notice of practices, not an additional contract term, and is not incorporated into these Terms. Agreement to these Terms is not consent to processing that requires separate consent under applicable law.

By providing contact information, you agree to receive transactional, security, support, and legal communications related to your account or use of the Services. Promotional email will include an unsubscribe method where required. Money Matchup will not treat an unsubscribe from marketing as an opt-out from necessary account, security, tax, payment, or legal notices.

11. Availability, changes, suspension, and termination

Money Matchup may add, remove, change, suspend, or discontinue a Service, feature, offer, or link. It may act immediately when reasonably necessary for law, security, fraud prevention, consumer protection, technical integrity, or a provider directive.

Money Matchup may update these Terms prospectively. The revised version will identify its effective date. For ordinary public use, continued use after the effective date constitutes acceptance to the extent permitted by law. Material changes governing a creator account or another relationship requiring affirmative assent will be handled under the applicable agreement and will not be imposed merely by passive continued use.

Money Matchup may suspend or terminate access for a material violation of these Terms, unlawful conduct, fraud, security risk, or conduct reasonably likely to harm consumers or the Services. Sections that by their nature should survive will survive, including intellectual property, disclaimers, limits of liability, disputes, and general terms.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” MONEY MATCHUP DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.

Money Matchup does not warrant uninterrupted or error-free operation, that every defect will be corrected, or that every product or provider will remain available. Nothing in these Terms disclaims an express promise or a warranty, consumer right, or remedy that cannot lawfully be waived.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONEY MATCHUP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST DATA, OR LOSS ARISING FROM A THIRD-PARTY PRODUCT DECISION, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONEY MATCHUP’S TOTAL AGGREGATE LIABILITY ARISING FROM THE PUBLIC SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID DIRECTLY TO MONEY MATCHUP FOR THE RELEVANT PUBLIC SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT.

These exclusions and limitations do not apply to fraud, gross negligence, willful misconduct, personal injury caused by negligence where the law prohibits limitation, or another liability or remedy that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.

14. Limited indemnification

To the extent permitted by law, you will defend and indemnify Money Matchup from a third-party claim and reasonable cost to the extent caused by your fraud, unlawful commercial use of the Services, knowing infringement or misappropriation of another person’s rights, malicious interference with the Services, or material breach of these Terms. You have no obligation to the extent a claim results from Money Matchup’s conduct, content, negligence, or breach.

Money Matchup will promptly notify you of a claim, provide reasonable cooperation at your expense, and allow you to control the defense with competent counsel. You may not settle a claim in a way that admits fault by, imposes nonmonetary duties on, or fails to release Money Matchup without its written consent, not to be unreasonably withheld.

15. Informal dispute resolution

Before filing a claim, you and Money Matchup will send a written notice describing the dispute and requested relief. Notices to Money Matchup must be sent to apple@creatorsagency.co and Creators Agency LLC, Attn: Legal, 30 N Gould St, Sheridan, WY 82801. The recipient will have 30 days to investigate and attempt in good faith to resolve the dispute. A party may seek urgent temporary relief when waiting would cause irreparable harm.

This informal process does not extend a limitations period unless applicable law or a written agreement provides otherwise.

16. Governing law and dispute forum

A claim arising from a Creator account, affiliate link, Creator payment, or Creator Program participation is governed by the dispute provision in the Creator Affiliate Program Agreement, which controls if these Terms conflict. For a claim arising solely from an unregistered visitor’s public use of the Services, these Terms and the claim are governed by Texas law, without regard to conflict-of-law principles, except to the extent federal law or nonwaivable law applies.

Unless applicable law gives you a nonwaivable right to another forum, you and Money Matchup consent to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas for a claim governed by this Section. Either party may bring an eligible individual claim in small-claims court. Nothing in these Terms limits a nonwaivable statutory right, remedy, or forum.

17. General terms

These Terms, together with documents expressly made contractual for a particular feature, are the entire agreement concerning public use of the Services. The Privacy Notice and Affiliate Disclosure provide notices and are not incorporated as contractual promises.

You may not assign these Terms without Money Matchup’s written consent. Money Matchup may assign them in connection with a merger, reorganization, sale of relevant assets, or transfer of the Services if the assignee assumes the applicable obligations.

Neither party is liable for delay caused by events beyond its reasonable control. If a provision is unenforceable, it will be enforced to the maximum lawful extent or severed without affecting the remainder. A waiver must be in writing and applies only to the stated instance. Headings aid navigation only. These Terms create no third-party beneficiary rights.
